Terms of Service
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the MyNotary website and platform (the "Platform") operated by MyNotary Ltd ("MyNotary", "we", "us"). By creating an account, booking a session, or otherwise using the Platform, you agree to these Terms.
MyNotary is a technology platform that connects individuals and businesses with independent, certified UK notary publics. MyNotary is not a law firm and does not provide legal advice, legal representation, or solicitor services. For legal advice regarding your documents or situation, consult a qualified solicitor.

2. Definitions
- "User", "you": any person or entity using the Platform.
- "Notary": an independent notary public authorised to practise under UK law who delivers notarisation services through the Platform.
- "Session": a scheduled remote online notarisation appointment conducted by video call.
- "Services": notarisation and related document services arranged via the Platform.
3. Eligibility and account
You must be at least 18 years old and have legal capacity to enter into binding contracts. You agree to provide accurate, complete registration information and to keep your account credentials secure. You are responsible for all activity under your account.
4. Platform services and fees
MyNotary facilitates booking, identity verification, document upload, video sessions, and payment processing. Fees for each service are displayed before you confirm a booking. Prices may change; the price shown at checkout applies to your booking.
Notarisation is performed by independent Notaries, not by MyNotary Ltd. MyNotary does not guarantee that any notarised document will be accepted by a foreign authority, government body, embassy, or third party.
5. Your obligations
You agree to:
- Provide valid identification and truthful information during verification and Sessions.
- Upload clear, complete documents suitable for remote notarisation.
- Attend Sessions on time with a stable internet connection and appropriate equipment.
- Use the Platform only for lawful purposes and in compliance with applicable laws.
- Not misrepresent your identity, documents, or authority to sign.
6. Role of independent notaries
Notaries are independent professionals. A notary–client relationship exists between you and the Notary performing your Session, not between you and MyNotary Ltd for the purpose of legal advice or notarial acts.
MyNotary may facilitate communication, scheduling, and payment but does not supervise or control the professional judgment of Notaries except as required for platform safety and compliance.
7. Payments
Payments are processed via our payment partners (e.g. Stripe). You authorise us to charge the payment method you provide for booked Services. Taxes, where applicable, are included or shown at checkout as stated.
Chargebacks or disputed payments made in bad faith may result in suspension of your account.
8. Cancellations and refunds
Cancellations, rescheduling, no-shows, and refunds are governed by our Cancellation Policy, which forms part of these Terms.
9. Intellectual property
The Platform, branding, software, and content provided by MyNotary (excluding your documents and Notary-generated outputs) are owned by or licensed to MyNotary Ltd. You receive a limited, non-exclusive licence to use the Platform for its intended purpose.
You retain ownership of documents you upload. You grant MyNotary a licence to store, process, and transmit your documents solely to provide the Services.
10. Acceptable use
You must not:
- Interfere with or disrupt the Platform or other users.
- Attempt unauthorised access to systems or data.
- Upload malware, unlawful content, or material infringing third-party rights.
- Use the Platform to commit fraud or impersonate others.
We may suspend or terminate access for breach of these Terms or for risk, legal, or regulatory reasons.
11. Disclaimers
The Platform is provided "as is" and "as available" to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including fraud or death/personal injury caused by negligence where applicable).
12. Limitation of liability
To the maximum extent permitted by law, MyNotary Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
Our total liability to you for claims arising from or related to the Platform (excluding liability that cannot be limited by law) shall not exceed the greater of (a) the fees you paid to MyNotary for the booking giving rise to the claim in the twelve months before the claim, or (b) £100.
13. Indemnity
You agree to indemnify MyNotary Ltd against claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Platform, or infringement of third-party rights, except to the extent caused by our negligence or wilful misconduct.
14. Termination
You may stop using the Platform at any time. We may suspend or terminate your account with notice where reasonable, or immediately for serious breach or legal requirement.
Provisions that by nature should survive (including liability limits, indemnity, and governing law) survive termination.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may also have mandatory rights under local law.

16. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance where permitted by law.
